1. Scope
These terms apply to the free iPhone app Summalo and the website summalo.app. The provider is named in the legal notice. Apple's standard license terms for apps (Licensed Application End User License Agreement) apply in addition. Mandatory law prevails over these terms.
2. What Summalo does
Summalo helps you estimate the price you pay in the US including sales tax. It reads price tags on your device, applies the sale you enter, and adds the tax rules and rates for the place you choose.
3. Estimates only
Prices, tax rates and clothing rules are estimates. They can be incomplete, out of date or wrong for a specific store, product, coupon or day. The store's register decides what you pay. Summalo is not tax, legal or financial advice. You use the results at your own responsibility.
4. Free of charge
Summalo is free. The provider may change, limit or discontinue the app and the website, as far as this is reasonable for you.
5. Community data (optional)
If you switch on sharing, you allow Summalo to store and use the anonymous facts described in the privacy policy (state, ZIP code and local rate, or brand and price position on a tag) and to show them in aggregated form to other users. Share only information you believe to be correct. Data may be ignored or removed.
6. Fair use
Do not misuse the service: no automated or abusive requests, no attempts to disrupt it, and no deliberately false data.
7. Brands
Summalo is independent and not affiliated with, endorsed or sponsored by any brand or store. Names such as Nike, adidas, Under Armour, Puma and New Balance belong to their owners and are used only to describe price tags.
8. Liability
The provider is liable without limit for intent, gross negligence, injury to life, body or health, and where the Product Liability Act applies. For slight negligence the provider is liable only for breach of an essential contractual duty (a duty that makes proper use possible and on which you can rely), and only for typical, foreseeable damage. Mandatory consumer rights remain unaffected.
9. Privacy
How data is handled is described in the privacy policy.
10. Changes
The provider may update these terms for new features or legal changes and will announce changes in good time in the app or on the website. If you keep using Summalo after the notice, the new terms apply to your further use. You can stop using Summalo at any time.
11. Law and severability
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection of the country where you live remains unaffected. If a provision is invalid, the others stay valid.
